On August 18, 2010, JT, through its counsel, wrote GSG accusing GSG's product, the ZLight LED of "infringing the `279 Patent" and demanding that GSG "cease and desist" marketing and selling the ZLight LED, a copy of which letter is attached hereto. JT's cease and desist letter creates a valid and justiciable controversy that continues to exist between JT and GSG. GSG desires a judicial declaration regarding the validity, enforceability and non-infringement by GSG of the `279 Patent and the parties' respective rights and obligations concerning such patent, and such a determination is necessary and appropriate at this time.

9.Although the letter from counsel for JT asserts that JT is the "exclusive licensee" of the `279 patent, no license document has been provided and there is no assertion that any license empowers JT to file the threatened suit on the `279 patent. Defendant Wang is the last recorded assignee of the `279 patent at the United States Patent and Trademark Office, see Assignment Records, attached hereto as Exhibit B..

10.No product made, used, sold, offered for sale or imported by GSG infringes any valid claim of the `279 patent.....

That patent is proof that the USPTO is off its rocker. It never should have been granted in the first place since many, many products of a similar type existed before the 2003 filing date.

If JT was going to blow the wad suing someone, why pick GSG of all companies? Pick someone bigger that you can actually win some decent financial reward from.

I predict that not only will JT lose and have to pay GSG for all their legal fees, but that their entire patent will be invalidated.

I suspect the JT LED will lose a lot in respect to patent disputes overtime. Just my opinion but it seems they will lose focus of what their intent was - to provide N Glantz with a low cost LED solution to account for the expensive GE and Sloan products. Seems rather odd that N Glantz would use a product like JT LED which has used products not protected by IP or licenses...but that might just be me and my vast experience on these LED legal issues.

The world of LED lighting will continue to be very very litigious and I expect a lot of people will not be suprised as it shakes out.

Anyone hear anything more about the JT LED and N Glantz issue with Nichia?

I know nobody really cares much about these lawsuits but I was wondering if anyone heard anything.
