We're sending our second one into training in July. We also have them sign a 2 year, prorated commitment for our investment. This is so if they don't take the training and run to a crane rental service without sharing the cost of the training. 

Cost is about $2K each, with hours and cost of training by the time it's done.

ATS in Wisconsin, gives a discount if buy training in packs. We bought a 3 pack for $1200/each. Not cheap!!!

Does anyone know if OSHA is enforcing the new requirement?

Or has anyone here been, or know of someone who has been actually charged with violating the requirement?

You will hear enforcement stories from whoever gets caught without it after an incident occurs, especially one with injuries.  That is when I would worry if you were required to have it.

Well, probably not, but it seems to me there are three things:

-       With the agreement you set the tone and exspectations

-       When you need the agreement, that employee has just quit so you have that last paycheck to take the money as outlined in the aggreement

-       The government (California it is EDD) now must get a complaint, understand the situation and act against you – they may not get the complain or move on it

So I think it achieves most of what you want even if it is unenforcable in the end.

 

Another question is – if the employee quits or wants to quit, do you want him anyway?
